The Interplay of Defamation Laws and Individual Honor in Pakistan: A Critical Review of Common Law Applications

Abstract

 


Pakistan's defamation laws are based on a combination of two ideas: common law principles and Islamic morals. This Paper discusses the relationship between personal integrity and the current defamation laws in Pakistan. This paper outlined the legal, cultural, and social tensions that exist in Pakistan between the protection of an individual's honor and the defamation laws. The major portion of the research indicated that while defamation laws were intended to preserve an individual’s reputation, they have also been found to have an impact on the right to free speech, particularly when powerful individuals use them to suppress protest.  This article addressed three following issues.



  1. 1. The Conflict between Defamation Laws and Freedom of ExpressionThe Impact of Honor on How Judges Interpret Defamation Cases.3. Pakistan's defamation law has been influenced by Islamic and common law principles.
